Please read these Terms & Conditions ("Terms") carefully before using the Usermate website and services operated by trinker media gmbh ("Usermate", "we", "us", or "our"), a company registered in Austria.
By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not use our services.
1. Eligibility
Our services are available to all users regardless of location. However, by registering for an account, you agree that you will not build, develop, or offer a similar product or service that competes with Usermate. Exceptions may be granted in individual cases, but prior written approval is required. Please contact us with your justification at support@usermate.org.
2. Account Use
Accounts are intended for use by the individual or entity that registered. Suspicious, abusive, or fraudulent activity may result in the immediate termination or suspension of your account and legal consequences.
We reserve the right to terminate or suspend accounts at our sole discretion at any time, without prior notice, especially in cases of misuse or breach of these Terms.
3. Payments & Subscriptions
All payments are processed securely via Stripe. Our subscription plans are billed either monthly or annually, depending on the selected plan.
Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings. If a payment fails (e.g. due to insufficient funds or card issues), your subscription will be terminated automatically.
All prices are excluding VAT. If you enter a valid VAT number during checkout (for EU businesses), no VAT will be charged.
4. Refund Policy
We do not offer refunds under normal circumstances. However, all users can try Usermate free for 14 days before starting a paid subscription, which provides ample time to evaluate the service.
In very exceptional cases, refunds may be considered—but only upon written request and at our sole discretion. Each request will be reviewed individually, and refunds are generally denied unless compelling reasons are provided.
No refunds will be issued for unused time, failed cancellations, or terminated accounts due to policy violations.
5. License & Usage
Usermate provides tools that assist in creating accessible websites, but we do not guarantee compliance with legal accessibility requirements (e.g. WCAG or local laws). Our platform is a supportive tool only, not a legal safeguard.
Users are granted a limited, non-exclusive, non-transferable license to use the service. We reserve the right to revoke this license at any time in cases of misuse, violation of these Terms, or suspected abuse.
6. Intellectual Property
All content, software, and intellectual property made available through Usermate are the property of trinker media gmbh or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the service without prior written permission.
7. Limitation of Liability
Usermate is provided "as is" and "as available" without warranties of any kind. We are not liable for any damages, data loss, business interruption, or legal consequences arising from the use of our service.
To the fullest extent permitted by law, we disclaim all liability related to:
- Your reliance on the accessibility features generated by the platform
- Errors, downtime, or interruptions in service
- Misuse or unauthorized use of the platform
8. Modifications
We may update or modify these Terms at any time. If a revision includes material changes, we will notify users at least 3 days in advance, where feasible. Continued use of the service after changes take effect constitutes your agreement to the updated Terms.
9. Governing Law
These Terms are governed by the laws of Austria, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Austria.
